Eugene man gets 20 years for 2018 stabbing death

EUGENE, Ore. – A man who killed a Eugene resident in 2018 was sentenced to 20 years in prison Monday morning.

David Justo Duran, 34, was sentenced after pleading guilty to manslaughter, first degree assault and unlawful use of a deadly weapon.

Duran was shot by Eugene police on June 30, 2018, after he stabbed Donald Rivers, 36, near downtown.

Lane County Senior Prosecutor Erik Hasselman called the crime completely preventable and said the two did not know each other. Hasselman said Duran was high on methamphetamine and was trying to kick down the front door of Rivers’ home on the corner of 13th Avenue and Washington Street at 4:30 a.m.

Rivers confronted Duran, who started to stab him. A friend of Rivers got Duran to stop by hitting him with a pogo stick.

Duran went into a backyard across the street, and when police found him, he was not cooperative and police shot him.

Rivers later died at a hospital.

Later, Duran told investigators he didn’t remember what happened, claiming he had consumed meth. A toxicology report later found he had an amount of meth in his system that can be fatal, Hasselman said.

Duran had been released from prison just eight days before the stabbing, Hasselman said.

"He is already so high that he's not controlling his behavior and kills an innocent man," Hasselman said.

During the sentencing hearing, friends and family of Rivers gave victim impact statements, telling the judge that their family will never be the same. In court, Duran apologized.

Rivers' sister, Karla, said that Donald was a musician who loved his family.

"My family is feeling relieved that this all finally over," Karla said. "We do have a tiny amount of comfort knowing that Mr. Duran takes some responsibility for his actions, but nothing can erase the unimaginable heartbreak that he has caused to our family and our friends."

Duran is not eligible for early release and will get credit for time served. He will also have to pay nearly $5,000 in restitution.
