Nursing home faces lawsuit after man dies

The suit says the facility was aware Pickering was prone to falling.

JUNCTION CITY, Ore - A nursing home is faced with a million dollar lawsuit after a man fell in the facility and later died. 

Court documents said Esbert James Pickering lived in the Avamere Rehabilitation Center when he fell and fractured his hip. About two weeks later, he died from complications.

Pickering's personal representative of his estate, Teresa Sanchez, is now suing the nursing home on his behalf. 

Documents claim the nursing home failed to provide Pickering with the adequate supervision, assistance and the proper number of floor mats by his bed.

The suit also said Pickering fell twice while in the nursing home, once on March 17, 2017, and the second only a day later on March 18. 

According to documents, the Plaintiff is alleging the facility should have done more to prevent the falls.

In a statement, Larry Lopardo, the Executive Vice-President of Avamere Health Services, said "Junction City will not comment on litigation matters. Federal and state privacy laws preclude it from commenting on anything involving a current or former patient."

The Plaintiff is seeking $1,500,000 for the cost of medical bills and damages.
