are lacking in the courtroom...and we have a follow up now to that tragedy in corvallis we told you about last summer. a family has filed a wrongful death lawsuit against a local athletic club after their fiv? yea?old drowned in a pool. as kezi 9 news reporter michael sevren show us their seeking 56 stand up: this 3? page lawsuit describes the drowning which took place in the outside pool of the timberhill athletic club. the attorney for the child's family alleges among other things? staff failed to provide the fiv?yea?old a life vest even though they knew he couldn't swim. the lawsuit says surveillance cameras filmed the child's drowning. fiv?yea?old tomas barreto pizano's life was cut short here at the timberhill athletic club in corvallis in june of last year. according to the lawsuit? the child went down a slide into water that was 7 inches over his head. the court documents say surveillance cameras captured him struggling to breath. they said over the next four minutes he surfaced close to 100 times? trying to get air. the family claims that club staff were not watching tomas and the other children in the pool. sot: heather louderback/ club member: the whole thing is devastating to everyone, the family, the community. i can't imagine how hard is to go something like that. i don't know much about the lawsuit and what it entails but i understand how policies could be updated and enforced. we reached out to the timberhill athletic club for comment... but they referred us to their lawyer who has not returned our phone calls. but in a statement made the day after the drowning... club officials said: "we, the timberhill families, individuals, staff,
